Through our website, www.workoutbythao.com (the “Website”) fitness and weight control programs (“Programs” or “products and services”) are provided for sale, which comply with these Terms of Use ("Terms"), and may be updated by us from time to time.
By accessing our Website and/or using our products or services in any way, you agree to abide by and be bound by these Terms.
In addition, by using our Website, you agree to follow any published guidelines for all products or services, which may subject to change from time to time, and to comply with all applicable laws, regulations and rules.
If you object to any Clause, any principle, or any subsequent revision, or if you are dissatisfied with the Website or our products or services, you should discontinue using the Website immediately.
These Terms remain in effect as long as you are a user of the Website and/or a registered user. In the event of terminating the membership, any service, or feature, you will remain bound by your obligations under these Terms, including any indemnities, guarantees, and limitations of liability. Online training course: Means a collection of multimedia Lectures regarding a certain topic.
Price (Service Fee): means the cost that customers shall pay to purchase access to 01 (one) specific Online Training Course provided by Workout By Thao. The selling price posted on workoutbythao.com includes Value Added Tax.
Learner/Customer: Means a person who is granted Access to Online Training Courses on Workout By Thao's platform and/or website.
Access to Online Training Courses: Means the permission to login to Workout By Thao's platform and/or website to view the content of Online Training Courses.

Workoutbythao.com is owned and operated by Munca Vietnam Company Limited. Activities on Workoutbythao.com include: Learners who have registered to use an account are approved by the website admin Board of Workout By Thao.
The transaction of buying and selling goods/services on Workout By Thao is carried out on the basis of the principles of freedom, voluntariness, equality, respect for the legitimate rights and interests of the parties involved, and does not violate regulations of the Law and Workout By Thao.
All products and goods/services traded on Workout By Thao fully meet the conditions as prescribed by Workout By Thao and relevant provisions of the Law, do not fall into the category of goods banned from trading, smuggled goods, and counterfeit goods.
Partners and Learners, when registering for an account and using the service on Workout By Thao's website, have agreed to the terms of operation, take legal responsibility for their behavior and commit to comply with all relevant regulations.
Workout By Thao undertakes to build regulations based on provisions on e-commerce and to comply with provisions of the Vietnamese law.

3.1 Process of order confirmation
For customers making direct payments in cash: Customers will be able to activate the course directly into their account at Workout By Thao office.
For Customers purchasing goods via bank transfer/online payment: Orders are confirmed by email from Workout By Thao with information of account, course code and related information so that customers can activate the Course.
3.2 Process of order cancellation:
Due to specific characteristics of the product, activation information is sent to customers immediately after payment, Workout By Thao shall not accept order cancellation requests for orders made via bank transfer/online/cash payment.
Any order cancellation request shall be forwarded to handle with requests for return and refund .
4. Return and refund process
If the Customer complies with the course 100% but it is not effective, the customer can call the hotline +841900636596 for advice on converting to another course or Workout By Thao will refund 100% of your amount.
4.1. Conditions for converting courses:
Time to request a refund shall not exceed 7 days from the date of payment.
Customers who bought an activated course and have not studied more than 50% of the course duration
Customers shall pay the difference if the new course has a higher value than the current course. The customer will be refunded the difference if the new course has a lower value than the current course.
4.2. Conditions for considering reasons for refund:
Technical errors related to the course arising from Workout By Thao
Payment errors: overpayment, duplicate payment of orders
Other reasons approved by Workout By Thao (Which do not violate Article 2 on refund policy)

All refund reasons are subject to review and photo-based proof
Workout By Thao reserves the right to decide to refund customers

4.3. Workout By Thao shall not refund in the following cases:
Problems arising from the students:
Customers confuse the course (For example, customers watch an advertisement for a similar course from another center but order from Workout By Thao)
Customers can't arrange time to study or don't want to study anymore
Technical errors from students: during the learning process, students encounter objective technical errors (damaged equipment, unresponsive network connection, old app/browser which cannot learn, ...)
Because customers fail to carefully read the information about the course: students should look up the information about the course before making a purchase. (Customers responded that they didn't know that the course was an online course?, they thought it was an online course, they could ask a teacher in class, a gym center ..v.v.)
Customers give general reasons (For example: They are not interested in studying anymore, the course is not suitable, they are unable to follow the course, ...)
Payment to a third party: If the student pays for the course to any other partner/individual but cannot not prove thay he/she has paid to Workout By Thao, then Workout By Thao cannot refund you. In this case, please contact the party that the student has made payment to request a refund
4.4. Refund time
Refund time depends on your initial form of payment.
Online payment (including payment via bank transfer; payment via visa/mastercard; payment via Vietnamese domestic ATM card; payment via online payment app such as Momo, Grabpay, Zalopay...): Refunds are available within 30 days from the date on which the refund request is approved.
4.5. Refund method:
In order to create convenience for customers, Workout By Thao make the only form of refund which is Bank Transfer. Therefore, when requesting a refund, you must provide the account number of beneficiary bank to Workout By Thao
4.6. Bank transfer charges
Workout By Thao refunds money by bank transfer, transfer charges incurred, if any, shall be borne by the customer. Depending on the beneficiary bank, the bank transfer charges will vary. Please contact a customer service specialist for more details.
Customers make payment by bank transfer, via payment gateway (gateway) and in cash: amount received by Customer = amount received by Workout By Thao - bank transfer charge
4.7. Verifying information when refunding
In order ensure the security of customers when refunding, Workout By Thao will verify your information.
Customers must use the Email which was registered with Workout By Thao to send information of the refund request. The course name requesting for refund, the Email registered on the system must match.

4.8. Refund policy when buying Combos
Combo is a group of courses sold with a special discount policy. Customers cannot refund for a course in a Combo but must cancel the entire combo. If you wish buy a course in a combo set, please buy it again with a new price policy.
4.9. Refund process
Customers can call hotline +841900636596. After reviewing the refund conditions, Workout By Thao will re-inform customers of the specific refund time. In order to receive a refund, the Customer's Course is required to satisfy the refund conditions (Refund Policy):

1. Payment between the Customer and Website Admin Board

When collecting Customer's personal information, Workout By Thao wishes to provide the most practical utilities to the Customer, protect the rights and ensure the respect for the Customer's privacy.
Within the scope of terms, Workout By Thao undertakes not to sell, lease or exchange the Customer information collected to any other subjects than the ones listed in this Regulation.
2. Scope of using Customer's information:
Information collected from Customers is used to the extent:
Provide consulting services to Customers according to information provided by Customers;
Send notices to the Customers about information exchange activities between the Website of Workout By Thao and members;
Ensure the safety of Customers when there is a risk of destroying, appropriating the Customers' account and impersonating the Customer;
Contact Customers to provide goods/services when Customers buy products/services on the website. Confirm information when purchasing and delivering goods;
Conduct surveys; promotional activities, provide updated information on the operation terms of the Website that affect Customers;
Customer information confidentiality is the top priority of Workout By Thao's Website when collecting Customer information. Workout By Thao always make every effort to keep up with standards of protecting customers' personal information; Workout By Thao requires password re-confirmation when logging in to prevent unauthorized access to the Customer's personal information system. In case the Customer leaves the computer and has not logged out from the website, the system will automatically log out after a period of time.
3. Storage time for Customer information
Workout By Thao will store information collected from the Customer from the time on which the Customer declares the information until the Customer's account is deactivated.
In case the Customer has a cancellation request sent to the Website Admin Board, the Customer's information will be deleted on the system after 03 days from the time the Customer makes a requests.

5. Method/Way for Customers to modify personal information on the data system
Customers can check, update, correct or cancel their personal information by themselves in the following ways:
Customers log into their own account, go to the personal information section and edit personal information;
Customers call the support phone number/support email of the Website Admin Board and request for having personal information edited.
6. Commitment to Customer information confidentiality
The Admin Board of Workout By Thao website undertakes to protect Customers' personal information according to the following contents:
Undertake to keep absolutely confidential according to the personal information protection policy of Workout By Thao Website;

In case of technical errors or data attacks, the Website Admin Board is responsible for notifying the competent authorities and Customers within 3 days from the date of the incident.
7. Subjects of information sharing
The website admin board may share and disclose the Customer's personal information when it believes that doing so is necessary to protect the Customer's interests, ensure the transaction safety for the Customer and at the request of an authorized third party.
The website admin board may use the Customer's personal information to research and recommend better products, goods and services to the Customer.
In case the Customer does not want to share information, Workout By Thao fully agrees upon receiving the request from the Client.
8. Mechanism to deal with violations of the commitment to use Customer's personal information
In case the Customer discovers that his/her personal information is used for improper purposes or the use of such personal information violates the terms specified in this Regulation, the Customer sends a claim to the company's hotline page: 1900636596 together with the information and grounds proving the violation of the website. The website admin board is committed to responding to the Customer's information within 24 hours from the date of receiving such claim so that the two parties can agree to come up with a solution.

The admin board of Workout By Thao website always makes everr effort and commits to provide the best technical infrastructure services to Customers and Partners during the transaction process, ensuring the safety and stability of the technical system.

X. Rights and responsibilities of the website admin board
1. Rights
Request Members (Learners) to provide complete, accurate and truthful information. In case there is a basis to prove that a member provides incorrect, wrong, incomplete information or violates the law or Vietnamese fine customs, Workout By Thao may refuse, suspend or terminate the member's right to use the service.
Workout By Thao reserves the right to change the price list of courses and payment methods to suit the needs and development direction of Workoutbythao.com and Munca Vietnam Company Limited
2. Obligations
Take responsibility to build the Website, including some main tasks such as: research, design, procure hardware and software equipment, Internet connection, develop a service policy for the activities of Workout By Thao Website within the permitted conditions and scope.
Take responsibility to build and supplement a system of knowledge and information on: e-commerce operations, system of domestic and international commercial legal documents, foreign markets, as well as news in connection with the operation of Workoutbythao.com.
Provide complete and accurate information and contact methods of Content Production Partners.
Provide full information about products provided on the trading website, Workoutbythao.com: information about products, prices, payment and delivery methods...
Ensure the accuracy and truthfulness of information about online Courses provided on e-commerce transaction websites.
Provide information on their business situation at the request of a competent state body to serve e-commerce statistics.
Comply with regulations of the law on payment, advertising, promotion, protection of intellectual property rights, protection of consumer rights and regulations of other relevant laws when selling goods or supplying services on e-commerce transaction website.
XI. Rights and responsibilities of the parties participating in the Website/application providing e-commerce services:
Rights and obligations of the Customer
1.1 Rights
Students may participate in free/paid courses of Workout By Thao.
Students will receive preferential policies provided by Workout By Thao. The preferential policy will be posted directly on the homepage of Workoutbythao.com and other information channels.
Students may comment on Workout By Thao during the use, all recommendations are sent directly by mail, phone, email. All comments and questions will be answered by the customer service department as soon as possible.
1.2 Obligations
Students will be responsible for the confidentiality and storage and all activities of using the service under their registered name, password and email address. Students are responsible for promptly notifying Workout By Thao of any unauthorized use of the account for the two parties to cooperate and settle.
Students commit and agree not to use Workout By Thao's services for illegal purposes, frauds, illegal information exploration, sabotage, creation and distribution of viruses that damage the information system, configure, transmit of Workout By Thao. Or use the service, create fake orders for the purpose of speculation, causing market manipulation.
Students undertake not to copy, modify, propagate, distribute courses or create similar tools of Workout By Thao without the consent of the Workout By Thao trading website.
Students must not act to discredit Workout By Thao in any form such as causing disunity among members, propagandizing, disseminating information which is false or not beneficial to the reputation of Workoutbythao.com.
2. Rights and Obligations of the Partner
2.1 Rights
May request support from Workout By Thao in the process of drafting and filming courses to ensure contents with high quality. The specific support will be specified in the cooperation agreement.
Make recommendations and/or suggestions for Workout By Thao to modify or supplement the content of Multimedia Lectures in case of details that may affect product quality, reputation and brand of each Party.
2.2 Obligations
Ensure the content of Lectures is consistent with the objectives of Workout By Thao and the Skill Training Program; correct for scientific knowledge and transferring practical skills; not contrary to ethical standards, fine customs and traditions of the Vietnamese nation.
Fully exercise tax obligations as prescribed by the law.
In case of a student's complaint about the course, the lecturer must cooperate with the management of the Workout By Thao transaction website to resolve.
XII.Applicable provisions
The Regulation of Workout By Thao officially takes effect from the date of signing the Decision issued together with this Regulation. Workout By Thao e-commerce website has the right and can change this Regulation by notifying on the Website. The revised Regulation takes effect after 05 (five) days from the date of the Decision on revision to the Regulation. The member's continued use of services after the revised Regulation is published and enforced means that the member has accepted this revised Regulation.
The operation Regulation will be continuously updated by Workout By Thao without prior notice. Members participating in Workout By Thao are responsible for complying with current regulations when transacting on the Website.
In the event of a dispute, the Workout By Thao E-commerce transaction website and the Content Production Partner will mediate on the basis of negotiation and mutual benefits. In case there are disputes that the Two Parties cannot resolve and conciliate by themselves, they will bring it to the Economic Court where Party A is headquartered for settlement. The Court's decision is final and binding on the parties. All costs incurred, including the winning party's attorney fees, are borne by the losing party.
Workout By Thao is responsible for receiving information about arising problems, performing the coordination function, requesting the parties to cooperate for handling the problem.
After the negotiation process to resolve the problem is completed, the parties are responsible for complying with the agreed agreement.
